VP in line of succession under fed’l charter revision

The House of Representatives has moved to revise the resolution on the federal constitution to include the vice president in the line of succession in case the president is incapacitated.

Cebu Rep. Raul del Mar has motioned to recommit Resolution of Both Houses No. 15 (RBH No. 15) back to the Committee on Constitutional Amendments on Wednesday to change the proposed line of succession in the transitory period of the charter change.

Section 4, Article XVII of the draft constitution reads: “In case a vacancy arises by reason of removal, resignation, permanent incapacity or death of the incumbent President, the incumbent Senate President shall act as President until a President shall have been chosen and qualified.”

“This is a motion to the speaker to recommit Committee Report No. 881 submitted by Committee on Constitutional Amendments on Resolution of Both Houses No. 15 in order to introduce perfecting amendments on the failure to include the vice president in the first line of succession which lead to some misunderstandings so there’s a need to clarify on this,” Del Mar said.

Del Mar’s motion was approved and Majority Leader Andaya said that in the part of the Majority, “at the proper time they would submit amendment to the committee as requested by Cong. Del Mar”.

Andaya said they will amend Line 29 on Page 44 in Article XVII or the Transitory provision and will” replace the word Senate by the word Vice”.

If the amendment will be approved, Andaya said that the provision will be read as “In case a vacancy arises by reason of removal, resignation, permanent incapacity or death of the incumbent President, the incumbent Vice President shall act as President until a President shall have been chosen and qualified.”

If the Federal Charter will succeed, the current draft proposed that Mr. Duterte’s successor will be the Senate President leaving Vice President Leni Robredo with no position during the transitory period.

This section also provides that there would be no extension for Duterte and Robredo beyond June 30, 2022, and Duterte cannot run for Presidency in 2022.
