It does look like Sen. Antonio Trillanes is headed for jail, city or military, sooner or later as the amnesty documents show that it was not President Aquino who had signed these but his defense chief, Voltaire Gazmin.
President Duterte pointed this out the other day, accusing Gazmin of usurpation of authority when he approved Trillanes’ application for amnesty.
Duterte insists that Trillanes failed to meet all the requirements necessary for one to be granted amnesty while Trillanes maintains that he had correctly applied for amnesty and admitted guilt.
To prove his point, Trillanes showed media a claimed pro-forma application form where there was a box and where the applicant checks on whether he had participated in coups d’etat against the government.
But, apparently, this is not sufficient proof that Trillanes had applied for and was quickly granted amnesty by the then Department of National Defense under the yellow regime.
Merely checking a box in a claimed pro-forma amnesty document creates the impression that the amnesty granted the rebels holds very little importance, despite giving these same Magdalo rebels not only their complete freedom but also Aquino’s erasure of the serious crime.
It makes a lot of sense that the so-called application for amnesty shown by Trillanes to the media is just that and should be treated more like an invitation with the usual RSVP on whether to apply or not.
It certainly makes a lot of sense for an applicant to submit a sworn affidavit stating his crime against the Gloria government through coups d’etat and not only as a participant but one that instigated the coups, then admit his guilt in black white and swearing to the truth of his written statement.
This is probably what is absent in Trillanes’ amnesty grant and the senator probably knows it which is why he continues to be too cowardly to face the music and keeps waving useless documents that do not prove anything.
Gazmin, however, issued a statement to the effect that Trillanes’ and at least 38 other Magdalo soldiers’ amnesty grants given eight years ago were aboveboard.

The President, who is not only a lawyer but also served as a prosecutor in his early career in Davao City, said the proclamation he issued invalidated only Trillanes’ privilege since “it is a presidential prerogative” to choose who gets an amnesty.
“It’s the President’s prerogative. You read the Philippine Constitution. The President shall have the power to pardon and grant amnesty with the concurrence, with the agreement of Congress,” Duterte told reporters at a briefing at the Davao International Airport upon his arrival from Jordan.
It does look like Duterte may have a strong constitutional case, given the proviso on presidential powers on amnesty, which would be very difficult for Trillanes and his lawyers to argue their case before the Supreme Court and win.
Already, Trillanes and his lawyers appear prepared to destroy the independence of the High Court when they claimed that the ruling of the court on the issue of the amnesty grant to the senator will favor Duterte and his government, which is a pretty stupid claim, especially since the constitutional proviso on the powers of the President not only spells these powers out, but also the failure of Trillanes to issue a sworn affidavit detailing his crime, Durerte said.

And probably Solicitor General Jose Calida, who had done the research on presidential amnesty grants and found the flaws in the amnesty grant. This is certainly not a crime even if Trillanes tries so hard to make it appear as a crime.
It is also probable that since Trillanes realizes that his goose is practically cooked, rumors—no doubt coming from him and his Magdalos—have swirled that yet another coup is being planned by disgruntled soldiers and over Duterte’s revocation of his and other coup participants.
All this talk started from the Trillanes camp is not likely to bear fruit, but if it does bloom into an actual coup, it is bound to fail anyway, especially since no yellow and certainly not Trillanes, or the commies, or the clerics, can hope to be a rallying force to reckon with.
Trillanes is nothing but a propagandist and a bearer of fake news to get him out of a serious scrape of his own making.
It’s time for Senate President Tito Sotto to step in and stop the nonsense being generated by Trillanes and the yellows.
Trillanes is just not worth it.
