Gadon sees 10-4 SC ruling against Sereno

THE lawyer who filed an impeachment complaint against Chief Justice Maria Lourdes Sereno, Lorenzo Gadon, predicted Friday that 10 justices of the Supreme Court (SC) will rule in favor of the quo warranto petition filed by the Office of the Solicitor General (OSG)  against Sereno.

During a studio guesting at ANC news channel, Gadon said four other justices can be expected to thumb down the petition.

The lawyer issued his forecast as the SC was scheduled to hold an en banc session to reportedly tackle the quo warranto petition against Sereno.

The OSG petition averred that the appointment of Sereno was void from the beginning because of her alleged failure to file all of her statements of assets, liabilities and net worth (SALN).

A ruling in favor of the quo warranto petition will have the effect of removing Sereno from office unless the SC rules that a sitting CJ may only be removed from office via impeachment.

An SC ruling against the quo warranto can be expected to touch off a full blown impeachment trial of Sereno at the Senate with members of the House of Representatives acting as prosecutors.

In 2012, then CJ Renato Corona was found guilty by the Senate sitting as an impeachment court on charges he did not declare properties in his SALN.

As of this posting, supporters and critics of Sereno are massed in front of the SC on Padre Faura St. in Manila.
